1. Description of Service

Nugibu is a rental marketplace platform designed to connect verified tenants with local hosts and landlords for the sharing and renting of residential spaces. Nugibu provides the technical platform, including property listings and real-time messaging functionality, to facilitate these connections.

Important Note: Nugibu is an online platform provider only. We are not a real estate broker, landlord, property manager, or insurer. We do not own, inspect, manage, or control any of the properties listed on the Service.

2. Eligibility and User Accounts

• Age Requirements: You must be at least 18 years old to create an account or use the Service.
• Account Accuracy: You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
• Account Security: You are responsible for safeguarding your password and any credentials used to access the Service. You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use of your account.

3. User Conduct & Real-Time Messaging

The Service includes features that allow users to interact, submit applications, and communicate in real time via WebSockets and chat rooms. You explicitly agree not to use the Service to:

• Post false, inaccurate, misleading, or defamatory content.
• Transmit any abusive, obscene, discriminatory, or unlawful messages or materials.
• Harass, spam, or bully other users, hosts, or tenants.
• Use automated bots, scripts, or scrapers to access the Service without express written permission.
• Attempt to circumvent the platform's communication tools to evade safety protocols or platform policies.

We reserve the right, but do not assume the obligation, to monitor, review, or terminate user access to real-time chat rooms and communication logs if a violation of these Terms is suspected.

4. Payment Processing & Financial Information

• Third-Party Payment Processor: Nugibu utilizes Stripe, Inc. ("Stripe") as our primary payment gateway. All online payments, fees, and money transfers are processed directly through Stripe.
• No Financial Data Storage: Nugibu does not collect, store, process, or have direct access to full credit card numbers, CVVs, or bank account credentials on our servers. All sensitive financial data submitted during payment is encrypted and handled directly by Stripe.
• Stripe Agreements: By conducting financial transactions on Nugibu, you agree to be bound by the applicable Stripe Services Agreement and Stripe Privacy Policy.
• Payment Disclaimers: Nugibu is not liable for payment processing failures, card declines, delay of payout funds, or security events originating directly from Stripe's infrastructure.

5. User-Generated Content & Image Licensing

• Ownership: You retain full copyright and legal ownership of any text, room descriptions, images, or photos ("User Content") that you submit, upload, or post to Nugibu.
• Grant of License: By uploading or posting User Content to Nugibu, you grant us a worldwide, non-exclusive, royalty-free, perpetual, sublicensable, and transferable license to host, store, display, reformat, reproduce, and distribute your content solely for the purposes of operating, promoting, and delivering the Service (including sending listing media to cloud infrastructure and CDNs such as Cloudinary).
• Content Representations: You represent and warrant that you possess all necessary copyrights, rights, and permissions for any content or photos you upload, and that your uploads do not infringe upon any third-party intellectual property or privacy rights.

6. Landlord and Tenant Relationships

• Independent Contracts: Any rental agreement, lease, or arrangement formed between a host/landlord and a tenant is solely between those parties. Nugibu is not a party to any such agreement.
• Compliance with Local Laws: Landlords are solely responsible for ensuring their listings comply with all local zoning laws, property taxes, housing regulations, and civil rights/fair housing legislation. Tenants are responsible for reviewing and understanding the terms of their individual lease arrangements.

7. Disclaimers & Limitation of Liability

• "As-Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy of listings, the safety of properties, or the conduct of any users.
• Limitation of Liability: To the maximum extent permitted by applicable law, Nugibu, its creators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or property damage resulting from your use of the Service or interactions with other users.

8. Indemnification

You agree to defend, indemnify, and hold harmless Nugibu, its founders, operators, affiliates, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including legal fees) arising out of or relating to your violation of these Terms, your User Content posted to the platform, your rental agreements with other users, or your violation of any applicable local, state, or federal laws.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise detrimental to the Nugibu community.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.

11. Changes to Terms

We modify these Terms from time to time. When changes are made, we will update the "Last Updated" date at the top of this document. Continued use of the platform after such modifications constitutes acceptance of the revised Terms.
